GLEESON CJ:   This appeal was heard in Canberra on 23 March 2000 by a Court constituted by Justices Gaudron, McHugh, Kirby, Hayne and myself.  The Court is in a position to publish its order now and we will publish our reasons for our decision at a later date. 

Justices Gaudron, McHugh, Hayne and I would dismiss the appeal with costs.

KIRBY J:   In my opinion, the order of the Full Court of the Federal Court of Australia should be set aside.  It should be ordered that the appeal to that court from the order of Justice Drummond be upheld.  The orders of Justice Drummond should be set aside and, in lieu of those orders, a number of other consequential orders made.  I will publish my reasons when the Court publishes its reasons.

GLEESON CJ:   The order of the Court is that the appeal be dismissed with costs.  I publish that order.
