GLEESON CJ:   This appeal was heard in Canberra on 23 March 2000 by a Court constituted by Justices Gaudron, McHugh, Kirby, Hayne and myself.  On 21 June 2000 the Court made and published its order in the matter.  The Court is now in a position to publish its reasons.

Justice McHugh and I considered that the appeal should be dismissed with costs and I publish our joint reasons.

HAYNE J:   Justice Gaudron and I joined in the orders dismissing the appeal.  I publish our joint reasons.

KIRBY J:   I was of the opinion that the appeal should be allowed and I announced the orders which I favoured on that day.  I now publish my reasons.
