Application for approval of the Formcon Group Pty Ltd Employee Collective Agreement 2007.
[1] This is an application by Formcon Group Pty Ltd seeking approval of an enterprise agreement titled Formcon Group Pty Ltd Employee Collective Agreement 2007 (the Agreement).
[2] As can be observed by the title of the Agreement it was not made pursuant to any relevant provisions of the Fair Work Act 2009 (the Act). The employer declaration in support of the application states that forty employees approved the Agreement to apply for a period of five years on 23 October 2008.
[3] This is not an agreement which can be considered under current legislation. It is clearly a document predicated on redundant provisions of the Workplace Relations Act 1996.
[4] The application has not been made in accordance with the Act, the approval sought pursuant to s.185 is refused and the application is dismissed.
