Forests (Miscellaneous) (Further Amendment)

Regulations 1998

The Governor in Council makes the following Regulations:

1. Objectives

The objectives of these Regulations are—

(a) to amend the Forests (Miscellaneous) Regulations 1989—

(i)  to extend the class of persons to whom certain regulations do not apply; and

(ii)  to amend the description of the Ada River forest operations zone in Schedule 3 to those Regulations; and

(b)

to revoke the Forests (Miscellaneous) (Amendment) Regulations 1998.

2. Authorising provision

These Regulations are made under section 99 of the Forests Act 1958.

3. Commencement

Forests (Miscellaneous) (Further Amendment) Regulations 1998

S.R. No. 146/1998

These Regulations come into operation on

26 November 1998.

4. Principal Regulations

In these Regulations, the Forests (Miscellaneous)
Regulations 19891 are called the Principal

Regulations.

5. Revocation

The Forests (Miscellaneous) (Amendment)

Regulations 19982 are revoked.

6. Persons to whom regulations do not apply

(1) In regulation 14A(2) of the Principal Regulations,

for paragraph (c) substitute—
"(c) is acting in the course of his or her duty as—

(i)  an authorised officer or member of the police force; or

(ii) an employee of the Department; or

(iii) an officer or member of a brigade within the meaning of the Country Fire Authority Act 1958; or

(d)

is carrying out works in a State forest on behalf of the Secretary.".

(2) In regulation 18(2) of the Principal Regulations,

for paragraph (a) substitute—

"(a) a person who is acting in the course of his or

her duty as—

(i)  an authorised officer or member of the police force; or

(ii) an employee of the Department; or

(iii) an officer or member of a brigade within the meaning of the Country Fire Authority Act 1958; or

(ab) a person who is carrying out works in a State

forest on behalf of the Secretary; or".

7.  Amendment of description of Ada River forest operation zone

In Part 1 of Schedule 3 to the Principal substitute "Ada Divide Track".

Regulations, in the description of the Ada River

8. Part 3 of Schedule 3 substituted

For Part 3 of Schedule 3 to the Principal
Regulations substitute—

ADA RIVER FOREST OPERATIONS ZONE

Legend

On the Plan of the Ada River Forest Operations Zone—

A is a point on Greens Road 1·25 km from B measured in a northerly direction along Greens

Road

B is the junction of Greens Road and Ada Divide Track C is the junction of Barlings Road and Ada Divide Track D is a point on Ada Divide Track 2·5 km from C measured in a south-easterly direction along

Ada Divide Track".
