No. 43 of 1954.

AN ACT to amend the Forests Act, 1918.

[Assented to 8th December, 1954.]

BE it enacted, by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Forests Act 2',Vigt.

Amendment Act, 1954.

(2) In this Act the Forests Act, 1918

Act No. 8 of 1919 as amended by Acts Nos. 31 of 1924, 18 of 1925, 11 of 1926, 9 of 1927, 13 of 1928, 28 of 1930, 41 of 1931, 27 of 1933, 7 of 1934, 9 of 1935, 17 of 1936 and 11 of 1937 and as affected by Acts Nos. 34 of 1920, 22 of 1939 and 42 of 1953—

is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Forests Act, 1918-1954.

amended.	2. Section four of the principal Act is amended by adding after the word, "flowers," in line four of the interpretation, "Forest produce", the word, "seeds,".

repealed.	3. Section six of the principal Act is repealed.

amended.	4. Section eight of the principal Act is amended

(a) by adding after subsection (1) the following subsection:—

(la) No person shall be appointed as Conservator of Forests unless he has obtained the degree or diploma of a forest school recognised by the Governor. ; and

(b) by repealing subsection (3).

5. Section nine of the principal Act is amended by adding after the word, "seal" being the last word in subsection (1), the words, "and shall have, and be deemed always to have had, power to acquire, hold, and dispose of real and personal property".

6. Section thirty-three of the principal Act is amended by adding after the word, "renewed" being the last word in subsection (3), the words, "from time to time by the Conservator upon such terms and conditions, and the payment of such fees and royal- ties, and for such period not exceeding in respect of any one renewal a period of ten years, as the Conservator determines and is hereby authorised to determine, generally, or in respect of a particular permit, class of permit, or classes of permits".

7.    Section thirty-four of the principal Act is ulded.

amended by substituting for the word, "ten" in line three of the proviso to subsection (2), the word, "fifty".

8.    Section thirty-five of the principal Act is u:nded.

amended

(a)	by adding after the word, "licensees," in line two of subsection (1), the words, "if any,"; and
(b)	by substituting for the word, "prescribed" where it occurs in both places in line two of subsection (2) the word, "such"; and by adding after the word, "thereunder" being the last word in subsection (2), the words, "as the Conservator determines and is hereby authorised to determine".

9. Section forty-one of the principal Act is amended.

amended

(a)	by substituting for the word, "Three-fifths", being the first word in subsection (2), the word, "Nine-tenths"; and
(b)	by adding after the word "concessions" being the last word in subsection (5), the words, "but shall not include rents derived from dwellings".

amended by substituting for the word, "fifty" in amended. 10. Section forty-three of the principal Act is S.43
