Act No. 134, 1985

An Act to amend the Forestry Act 1916 as a consequence of and in

connection with the Western Lands (Amendment) Act 1985. [Assented

to. 25th November, 1985.]

Forestry (Clearing Licences) Amendment 1985

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the "Forestry (Clearing Licences)

Amendment Act 1985".

Commencement

2. (1) Sections 1 and 2 shall commence on the date of assent to this

Act.

(2) Except as provided by subsection (1), this Act shall commence on the day on which Schedule 1 (2) to the Western Lands (Amendment) Act 1985 commences.

Amendment of Act No. 55, 1916

3. The Forestry Act 1916 is amended in the manner set forth in

Schedule 1.

SCHEDULE 1

(Sec. 3)

AMENDMENTS TO THE FORESTRY ACT 1916

(1) Section 27 (3) (a) (ia)—

After section 27 (3) (a) (i), insert:

(ia) in pursuance of a clearing licence under section 18DB of the Western Lands Act 1901 or if it is the doing of a thing for which a clearing licence is not required under that Act by reason of section 18DB (4) of that Act;

(2) Section 27H (bl)—

After section 27H (b), insert:

(b 1) in respect of Crown-timber lands which are the subject of a lease under the Western Lands Act 1901 and are not within a State forest or timber reserve;
