Forestry Amendment (Notice) Regulation 2015

1      Name of Regulation

This Regulation is the Forestry Amendment (Notice) Regulation 2015.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Forestry Regulation 2012

(1) Clause 6 Control of persons, vehicles and machines in forestry area

Omit clause 6 (4). Insert instead:

(4) A person who, without the prior permission of the Corporation, does
any of the following is guilty of an offence:

(a)

the person enters or remains in a forestry area that the person is prohibited from entering under subclause (1),

(b)

the person drives a vehicle into or within a forestry area that the vehicle is prohibited from entering under subclause (1),

(c)

the person causes a machine to enter or remain within a forestry area that the machine is prohibited from entering under subclause (1).

Maximum penalty: 20 penalty units.
(2) Clause 55A
Insert after clause 55:
55A Publication and contravention of notices
(1) The Corporation is to publish on a website of the Corporation (and any other government website or publication it considers appropriate) information about prohibitions imposed by notices displayed under this Regulation in forestry areas that it considers necessary to bring relevant prohibitions to the attention of the public.
(2) A person contravenes a prohibition imposed by a notice displayed in a forestry area whether or not it is established that the person had read the notice.
