Explanatory note
The object of this Regulation is to amend the Forestry Regulation 2012 to prescribe the Chief Executive of

the Office of Environment and Heritage as a person to whom the Minister may delegate the exercise of regulation-making power).

1      Name of Regulation

This Regulation is the Forestry Amendment (Delegation) Regulation 2016.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Forestry Regulation 2012

(1) Clause 54

Insert “of Corporation” at the end of the heading to the clause.

(2) Clause 55 Delegation of certain functions of Minister
Insert at the end of the clause:
(2) For the purposes of section 90 of the Act, the Chief Executive of the Office of Environment and Heritage is authorised as a person to whom the Minister may delegate the exercise of the following functions of the Minister:
(a) the appointment under section 70 of the Act of employees of the Office as authorised officers for forestry areas for which the Chief Executive is the land manager,
(b) the issuing of identification cards under section 72 of the Act to such authorised officers (including the signing of any such card),
(c) the function of approving forest permits under section 61 (1) of the Act for forestry areas for which the Chief Executive is the land manager.
