Forestry Amendment Act 2009

An Act to amend the Forestry Act 1920

[Royal Assent 12 November 2009]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Forestry Amendment Act 2009 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Forestry Act 1920 is referred to as the Principal Act. 4Section 4D insertedAfter section 4C of the Principal Act , the following section is inserted in Part I: 4DExemption of certain vehicles from laws specifying vehicle mass, weight or dimension limits (1)  In this section – combination has the same meaning as in the Vehicle and Traffic Act 1999 ; vehicle has the same meaning as in the Vehicle and Traffic Act 1999 . (2)  Except as otherwise provided by the regulations, a law of Tasmania does not apply in respect of the use of a vehicle, or combination, on a forest road if the law would otherwise operate to prohibit or restrict the use on a forest road of a vehicle, or combination, that exceeds a certain mass, weight or dimension (whether inclusive or exclusive of its load). 5Section 25 amended (Signage) Section 25 of the Principal Act is amended by inserting after subsection (1) the following subsection: (1A)  The corporation shall, wherever practicable, erect signs stating that a particular road is a forestry road. 6Section 26 amended (Closure of forest roads) Section 26 of the Principal Act is amended as follows: (a) by omitting "vehicular traffic." from the definition of prescribed sign in subsection (1) and substituting "all traffic or to a class of traffic;"; (b) by inserting the following definition after the definition of prescribed sign in subsection (1) : traffic means pedestrian or vehicular traffic. (c) by omitting from subsection (2) "vehicular traffic" and substituting "all traffic, or to a class of traffic,"; (d) by omitting from subsection (6) "vehicular traffic" and substituting "all traffic, or to a class of traffic,". 7Repeal of ActThis Act is repealed on the ninetieth day from the day on which it commences.
