Queensland Forestry Amendment Act 1999 Act No. 79 of 1999 An Act to amend the Forestry Act 1959 [Assented to 14 December 1999]
s1 4 Forestry Amendment The Parliament of Queensland enacts— s4 No. 79, 1999 ˙ Short title 1. This Act may be cited as the Forestry Amendment Act 1999 . ˙ Act amended 2. This Act amends the Forestry Act 1959 . ˙ Amendment of s 5 (Definitions) 3. Section 5— insert — ‘ “native forest hardwood sawlogs” means native hardwood timber for use for sawmilling. “native forest sawlog allocation system” see section 69A. “sales permit” means a permit granted under section 56.’. ˙ Amendment of s 46 (Corporation may sell forest products or quarry material the property of the Crown) 4.(1) Section 46(2), from ‘permit’— omit, insert — ‘sales permit for getting the forest products or quarry material’. (2) Section 46— insert — ‘ (3) Without limiting subsection (2), a sales permit for getting native forest hardwood sawlogs under the native forest sawlog allocation system for south-east Queensland may— (a) be granted for a period of not more than 25 years; and (b) provide for compensation payable to the permittee in stated
s5 5 s7 Forestry Amendment No. 79, 1999 circumstances; and (c) require the permittee to give the State the first right of refusal to an assignment or transfer of the permit.’. ˙ Amendment of s 58 (Power to cancel, suspend, permit, licence etc.) 5. Section 58— insert — ‘ (8) Subsection (7) does not prevent the payment of compensation for suspension or cancellation of a sales permit in particular circumstances if the permit provides for compensation to be paid in the circumstances.’. ˙ Amendment of s 69C (Specific authorisation for grant of permit to get native forest sawlogs) 6. Section 69C(2)— insert — ‘(f) the payment of compensation to the permittee in stated circumstances; (g) the State’s first right of refusal to an assignment or transfer of the permit.’. ˙ Amendment of s 69D (Expiry of pt 7A) 7. Section 69D, ‘1 year after it commences’— omit, insert — ‘on 27 November 2009’. © State of Queensland 1999
