Forestry (Amendment) Act 1933 (NSW)
FORESTRY (AMENDMENT) ACT.
Act No. 7, 1933.
An Act to provide for the appointment of an Acting-Commissioner to constitute the Forestry Commission of New South Wales for a less term than the term prescribed in the Forestry Act, 1916, as amended by subsequent Acts, and at a less salary than that appropriated by the said Act as so amended; to amend the said Act; and for purposes connected therewith. [Assented to, 13th September, 1933.]
BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis- Wales in Parliament assembled, and by the authority of the same, as follows :— 1 . (1) Thi-s Act may be cited as the "Fores t ry (Amendment) Act, 1933."
(2) The F o r e s t r y Act, 191(3, as amended by subse quent Acts, is in this Act referred to as the Pr inc ipa l Act.
(3) The Pr inc ipa l Act, as amended by this Act, may
be cited as the F o r e s t r y Act, 1916-1933.
2. The Pr inc ipa l Act is amended by inser t ing next
af ter section six the following new section:—
6A. (1) The Governor may, in lieu of appoint ing a commissioner upon the expirat ion of the t e rm of office of the commissioner holding office a t the com
mencement of the F o r e s t r y (Amendment) Act, 1933, appoin t such commissioner or some other person as
acting-commissioner.The ins t rument of appoin tment shall specify the t e rm for which such person is appointed but such t e rm shall not exceed seven years .
(2) Dur ing the period for which he is ap pointed an acting-commissioner shall, for the pur poses of this Act, be deemed to be the person for the t ime being holding the office of commissioner, and
shall consti tute the F o r e s t r y Commission. (3) An acting-commissioner shall have and may exercise and perform all the r ights , powers, authori t ies , duties and functions and shall be subject to all the obligations which by or under this Act are conferred or imposed upon the commissioner.
(4) The provisions of subsections two to five,
both inclusive, of section five of this Act shall apply
to and in respect of an acting-commissioner. (5) The sa la ry of an acting-commissioner shall be one thousand two hundred and fifty pounds and shall be subject to the provisions of the Public Service Salar ies Act, 1931-1933.
