[A ssented to 17 th D ecembeb , 1957.] B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis lativeAssembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. This Act may be cited as “ The Forestry Act Short title- o/1957.” 2. In this Act, unless the context otherwise indicates J?t°rpreta" or requires, the following terms shall have the meanings respectively assigned to them, that is to say:— “ Director of Forests ”—The person who, Director of pursuant to *“ The Public Service Acts , 1922 °res s' to 1955,” holds at the passing of this Act the position designated as “ Director of Forests ”, and successively every person appointed to that position after the passing of this Act: the term includes any person performing for the time being the functions and duties of that position; “ Department ”—A Department under and within Department, the meaning of *“ The Public Service Acts, 1922 to 1955 ” ; “ Forestry Board ”—The Forestry Board within Forestry the meaning of f“ The State Forests and oar ' National Parks Acts, 1906 to 1948,” as incorporated by section eighteen of J“ The Sandalwood Act of 1934 ” ; “ Land Administration Board ”—The Land ^^inigtra Administration Board constituted pursuant «0™Bolrd. to the provisions of §“ The Land Acts Amendment Act of 1931.”* * * § * 13 G. 5 No. 31 and amending Acts, f 6 E. 7 No. 20 and amending Acts. } 25 G. 5 No. 18. § 22 G. 5 No. 39.

(2.) The constitution on and from the passing of this Act of the Director of Forests as the Forestry Board under and for the purposes of *“ The State Forests and National Parks Acts, 1906 to 1948,” f“ The Sandalwood Act of 1934,” %uThe SawmillsLicensingAct of 1936,” §“ The Timber Users’ Protection Acts, 1949 to 1955,” and any other Act or enactment shall not affect the continuity of the identity, or any rights or obligations, of the said Board, or render defective any legal proceedings by or against the said Board, and any legal proceedings that might have been commenced or continued by or against it as constituted by the Land Administration Board may be commenced or continued by or against it as constituted by the Director of Forests. Department 4. For the purposes of ||“ The Public Service Acts, of Forestry. 1922 to 1955,” the Forestry Board, and the officers who at the date of the passing of this Act constitute the sub-Department of Forestry, and to whom ||“ The Public Service Acts, 1922 to 1955,” apply, shall, on and from the date of the passing of this Act, cease to be a sub-Department of the Department of Public Lands and become and constitute a Department under the name of the “ Department of Forestry ”, and the Director of Forests shall be the permanent head of that Department, unless and until another person is defined by the regulations under ||“ The Public Service Acts 1922 to 1955,” to be that permanent head. Deputy- 5. (1.) In this section the Deputy-Director of FDoirreecsttos. r of Forests means the holder for the time being of the position in the Department of Forestry designated “ Deputy-Director of Forests ”.* * * § * 6 E. 7 No. 20 and amending Acts. f 25 G. 5 No. 18. t 1 E. 8 No. 2. § 13 G. 6 No. 37. FORESTRY. 1957. ForestryAct. (2.) The Deputy-Director of Forests may, in the event of the absence from duty for any reason whatsoever of the Director of Forests act as Director of Forests and while he so acts shall have and may exercise all of the powers, functions and authorities and perform all of the duties of the said Director (including, unless another person is then defined by the regulations under *“ The Public Service Acts, 1922 to 1955,” to be the permanent head of the Department of Forestry, as that permanent head). The fact that the Deputy Director of Forests has exercised any power, function or authority or performed any duty of the Director of Forests shall, until the contrary is proved, be conclusive evidence that the said Director was then absent from duty. (3.) In the event of a vacancy in the office of the Director of Forests the Deputy-Director of Forests shall act as Director of Forests until another person is appointed to that office and while he so acts shall have and may exercise all of the powers, functions and authorities and shall perform all of the duties of the said Director (including, unless another person is then defined by the regulations under *“ The Public Service Acts, 1922 to 1955,” to be the permanent head of the Department of Forestry, as that permanent head). * 13 G. 5 No. 31 and amending Acts. 73
