FORESTRY ACT 1916—REGULATION

(Relating to fees and authorisations to take timber etc.)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Forestry Act 1916, has been pleased to make the Regulation set forth hereunder.

Commencement

  1. This Regulation commences on 1 January 1994.

Amendments

2. The Forestry Regulation 1983 is amended:

(a) by omitting clause 4;

(b) by inserting after Division 1 of Part 4 the following Division:

Division 2—Authorisations under section 301 of the Act

Value of timber etc. to be taken by authority from certain land

45. For the purposes of section 301 (a) and (b) of the Act, the

prescribed value is $750.

EXPLANATORY NOTE

The objects of this Regulation are:

(a)

to specify, and generally increase, the fees in respect of licences, leases and certain permits and matters under the Forestry Regulation 1983; and

(b)

to allow authorised persons to take timber, timber products or forest materials valued at $750 or less on or from land within State forests (but excluding flora reserves) or Crown lands.

This Regulation also omits an arrangement provision as its content is already

covered by a table of provisions.

This Regulation is made under the Forestry Act 1916, including section 41 (the general regulation-making power) (in particular, section 41 (1) (b) and (n)), and section 301.
