His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Forestry Act 1916.

Explanatory note
The object of this Regulation is to increase the prescribed amount of penalty for the offence of contravening a condition or limitation of a licence, permit. forest lease or other authority issued under the Forestry Act 1916 or the Forestry Regulation 1994 when dealt with by way of penalty notice.
This Regulation is made under the Forestry Act 1916, including sections 41
(the general regulation-making power) and 46A.

1 Name of Regulation
This Regulation is the Forestry Amendment (Penalties)
Regulation 1998.
2 Amendment of Forestry Regulation 1994
The Forestry Regulation 1994 is amended as set out in Schedule
1.

(Clause 2)
Omit the clause. Insert instead:
75 Prescribed amount of penalty under section 46A of the
Act For the purposes of section 46A (2) (c) of the Act, the prescribed amount of penalty for an offence dealt with under section 46A of the Act is:
(a)
in the case of an offence against clause 73— $1,000, and
(b) in any other case—$100.
[2] Schedule 2A Short descriptions
Omit the matter relating to clause 73 in Columns 1 and 2 of the
Schedule.
Insert instead:
Clause 73—contravene condition or contravene condition of authority limitation of licence. permit, forest
lease or other authority
