FOREST MANAGEMENT AMENDMENT REGULATIONS 1998

Made by the Governor in Executive Council.
Citation
1. These regulations may be cited as the Forest Management Amendment

Regulations 1998.

Principal regulations

2.  In these regulations the Forest Management Regulations 1993* are referred to as the

principal regulations.

Regulation 2 amended

3.  Regulation 2 of the principal regulations is amended by inserting before the definition

of "bush landing" the following definition —

"apiary site permit" means a permit referred to in regulation 73 (1);

Regulation 73 amended

4. (1) Regulation 73 (1) of the principal regulations is amended by deleting "grant to

any person" and substituting the following

, upon an application in writing by a person, grant to the person ".

(2)	Regulation 73 (3) of the principal regulations is amended —
(a)	in paragraph (a) by deleting "4" and substituting the following —

" 5 ";and

(b) in paragraph (b) by deleting "2" and substituting the following —

" 4 ".

Regulation 76 repealed and regulations substituted

5.  Regulation 76 of the principal regulations is repealed and the following regulations

are substituted

Exercise of rights conferred by a permit

76.  A permit-holder shall not exercise the rights conferred by the permit otherwise

" other than an apiary site permit " .

than in good faith for his or her own benefit.
Transfer of a permit
76A. The Executive Director may, upon an application in writing by a

permit-holder, transfer a permit to another person.

Variation of a permit to change an apiary site
76B. The Executive Director may, upon an application in writing by a
permit-holder, vary a permit so as to change the location of the area to which the

permit applies.

Regulation 82 amended

6. Regulation 82 of the principal regulations is amended —

(a) in paragraph (a) by deleting "$34" and substituting the following —

" $60.00 ";and

(b) in paragraph (b) by deleting "$6.80" and substituting the following —

" $12.00 ".

Schedule 5 amended
7. (1) Schedule 5 to the principal regulations is amended in item 6 by inserting after
"permit" the following —

(2) Schedule 5 to the principal regulations is amended by inserting after item 6 the

following items —

7.Grant of an apiary site permit

in the south-west zone —

per 5 permits or less

granted on one application S100.00

8.Grant of an apiary site permit

outside the south-west zone —

per 5 permits or less

granted on one application S50.00
9.	Transfer of an apiary site permit S8.50

10.Variation of an apiary site permit

so as to change the location of the

area to which the permit applies to

a location in the south-west zone S75.00

11.Variation of an apiary site permit

so as to change the location of the

area to which the permit applies to

a location outside the south-west zone $37.50
