No. XXXVII.

An Act to apply the provisions of the New South
Wales Steam Navigation Act of 1852 to

Foreign Vessels engaged in the Colonial

Passenger Trade. [28th October, 1853.]

WHEREAS " The New South Wales Steam Navigation Act of applicable only to vessels being British vessels or owned wholly or in 1852 " is by the terms of the fifty-eighth section thereof made

part by British subjects And whereas a portion of the regular passenger traffic from this Colony is now being conducted in and by steamers not being British vessels and which are owned wholly by Foreign persons and it is necessary to place such steamers under the laws and regulations contained in the said Act Be it therefore enacted by His Excellency the Governor of New South Wales by and with the advice and consent of the Legislative Council thereof as follows:—

1. The said recited Act and all and every the laws and regula­ tions therein contained shall from and after the passing of this Act apply to and in relation to steamers not being British vessels or not owned wholly or in part by British subjects which shall be engaged in the trade of conveying passengers from any port or place in this Colony to any port or place in any other part of the British Dominions in the same manner and to the same extent in all respects as if such steamer were a British vessel anything in the said recited Act to the contrary thereof notwithstanding.

2. Before any Foreign steamer shall clear out or proceed on any voyage with passengers from any port of this Colony to any other of Her Majesty's possessions the owner or charterer or in the absence of such owner or charterer one good and sufficient person on his behalf to be approved of by the Chief Officer of Customs at the port of clearance shall with the master of the said steamer enter into a joint and several bond in the sum of five hundred pounds to Her Majesty Her Heirs and Successors according to the form contained in the Schedule hereto the condition of which bond shall he that the said steamer is in all respects seaworthy and that all the requirements of the said recited Act and of any regulations made by the New South Wales Steam

Navigation Board in virtue of the said recited Act have been and shall for so long as the said vessel shall he engaged in the trade of conveying passengers from this Colony to any other of Her Majesty's Possessions

be in all respects well and truly fulfilled and performed and that the

master of such steamer shall submit himself in like manner as a British subject being the master of a British steamer to the jurisdiction of such Courts and Magistrates as are by the said recited Act empowered to adjudicate on offences committed against the said Act and the said regulations and shall and will well and truly pay all penalties fines and forfeitures which he may be adjudged to pay in respect of any breach or non-performance of any of the requirements of the said Act or of the said regulations Provided that the enactment contained in this clause shall not take effect until the same shall have received Her Majesty's approbation and such approbation shall have been signified by the Governor in the New South Wales Government Gazette or by Message to the Legislative Council.

Form of Bond to be given by Owner or Charterer and Master.

KNOW ALL MEN BY THESE PRESENTS That we are held and firmly bound unto Her Majesty Queen Victoria in the sum of Five hundred pounds of good and lawful money of Great Britain to be paid to Her said Majesty the Queen Her Heirs and Successors to which payment well and truly to be made we bind ourselves and every of us jointly and severally for and in the whole our heirs executors and administrators and every of them firmly by these presents.

and if the Master for the time being of the said ship shall submit and conform himself in like manner as a British subject being the Master of a British passenger steamer to the jurisdiction of the Courts and Magistrates in Her Majesty's Possessions which are by the said Act empowered to adjudicate on offences com­ mitted against the said Act and the said Regulations and if moreover all penalties fines
and forfeitures which the Master of such ship may be adjudged to pay for or in respect of the
breach or non-fulfilment of any such requirements as aforesaid shall be well and truly paid
then this obligation to be void otherwise to remain in full force and virtue.

Now the condition of this obligation is such that if the steamship well and truly fulfilled and performed
whereof is Master is in all respects seaworthy and if all and every the

requirements of the "New South Wales Steam Navigation Act of 1852" and of any
