Foreign Fishing Boats Levy Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Foreign Fishing Boats Levy Act 1981.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Foreign Fishing Boats Levy Regulations.

Interpretation

2. Regulation 3 of the Principal Regulations is amended:

(a) by omitting the definition of “agreement”; and

(b) by inserting after the definition of “the Act” the following definition:

“ ‘the Secretary’ has the same meaning as in the Fisheries Act 1952.”

3. Regulation 4 of the Prinicipal Regulations is repealed and the following regulation substituted:

Prescribed class of foreign fishing boats

“4. For the purposes of subsection 4 (2) of the Foreign Fishing Boats Levy Act 1981,a foreign fishing boat is included in a prescribed class of foreign fishing boats if, in respect of that boat:

(a) there is an instrument in force under subsection 4 (2) of the Fisheries Act 1952; and

(b) a resident of Australia who is:

(i) an Australian citizen; or

(ii) a company registered in Australia in which the majority of shares is held by persons who are both residents of Australia and Australian citizens;

provides evidence to the satisfaction of the Secretary, or a person authorised in writing by the Secretary in that behalf, that the person or the company is the owner of the boat.”.

Repeal of regulation 5

4. Regulation 5 of the Principal Regulations is repealed.

Levy payable under subsection 5(1) of the Act

5. Regulation 6 of the Principal Regulations is amended:

(a) by omitting “section 5” and substituting “subsection 5 (1)”; and

(b) by omitting “otherwise than in accordance with the agreement”.
