1. Name of Regulations [see Note 1]

These Regulations are the Foreign Evidence (Application of Amendments) Regulations 2011.

1. Commencement [see Note 1]

These Regulations commence on the day after they are registered.

1. Definitions

In these Regulations:

Act means the Foreign Evidence Amendment Act 2010.

commencement day means the day on which these Regulations commence.

1. Application of amendments to State and Territory court proceedings

(1)This regulation applies to a proceeding:

(a)in a court of:

(i)Western Australia; or

(ii)South Australia; or

(iii)Tasmania; or

(iv)the Australian Capital Territory; or

(v)the Northern Territory; and

(b)to which subsection 20 (2) of the Foreign Evidence Act 1994 applies; and

(c)that commenced on or after the commencement day.

(2)For subitem 19 (2) of Schedule 1 to the Act, the amendments made to the Foreign Evidence Act 1994 by Schedule 1 to the Act apply to the proceeding.
