The following local environmental plan is made by the local plan-making authority under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Forbes Local Environmental Plan 2013 (Amendment No 9).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land at River Road, Forbes, being Lot 6, DP 619205 and Lot 1,

DP 242593.

4      Maps

The maps adopted by Forbes Local Environmental Plan 2013 are amended or replaced, as the case requires, by the maps approved by the local plan-making authority on the making of this Plan.

5 Amendment of Forbes Local Environmental Plan 2013

Clause 7.9

Insert after clause 7.8—

7.9

Subdivision of certain land at Forbes

(1)

The objective of this clause is to ensure dwelling houses are not

developed on certain land at high risk of flooding.

(2)

This clause applies to land at River Road, Forbes, being Lot 6, DP

619205 and Lot 1, DP 242593.

(3)

Despite any other provision of this Plan, development consent may be granted for the subdivision of land to which this clause applies only if—

(a)

the subdivision is for the purpose of the erection of a dwelling house on each lot resulting from the subdivision, and

(b)

each lot resulting from the subdivision will have a minimum lot size of 2 hectares and consist of at least 1,000 square metres of land that is not identified on the Flood Planning Map as “Area A”, and

(c)

a dwelling house will not be located on land identified on the Flood Planning Map as “Area A”.
