The following local environmental plan is made by the local plan-making authority under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Forbes Local Environmental Plan 2013 (Amendment No 10).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land zoned RU5 Village under Forbes Local Environment Plan

2013.

4      Maps

The maps adopted by Forbes Local Environment Plan 2013 are amended or replaced, as the case requires, by the maps approved by the local plan-making authority on the making of this Plan.

[1]      3.1 Exempt development

Insert after clause 3.1(6)—

(6A)

Despite clause 1.9(1) of State Environmental Planning Policy (Exempt and

Complying Development Codes) 2008 that Policy does not apply to

development for the purpose of the installation of rainwater tanks (above

ground) on land within Zone RU5.

[2]      Schedule 2 Exempt development

Omit “(When this Plan was made this Schedule was blank)”. Insert instead—

Rainwater tanks (above ground)

(1)

Must be on land zoned RU5.

(2)

Must be located at least 1m from each lot boundary, if the tank has a height of

more than 1.8m above ground level (existing).

(3)

Must result in the total land surface covered by rainwater tanks being more

than whichever is the lesser of—

(a)

20% of the lot size, or

(b)

200 square metres.

(4)

Must be located behind the building line of any road frontage.

(5)

Must not rest on the footings of an existing building for support.

(6)

Must not require cut and fill of more than 1m below or above ground level

(existing).

(7)

Must be fitted with a screened rain head designed to ensure self-cleaning and

prevent leaf litter entering into the water tank.

(8)

Must be fitted with a first-flush device incorporating an automatic resetting

valve that causes initial run-off rainwater to bypass the tank.

(9)

Must be installed with inlets and outlets designed to prevent mosquitoes

breeding in it.

(10)

Must have its overflow connected to an existing stormwater drainage system that does not discharge to an adjoining property, or cause a nuisance to adjoining owners.

(11)

Must have a sign affixed to it with a statement to the effect that the water in

the tank is rainwater.

(12)

Must not detract, including by way of colour or location, from any heritage

item on the property.
