Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Forbes Local Environmental Plan 1986 (Amendment

No 16).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land in the following zones under Forbes Local

Environmental Plan 1986:

(a)

Zone No 1 (a) (Rural Zone),

(b)

Zone No 1 (c) (Rural Residential Zone),

(c)

Zone No 2 (a) (Residential Zone),

(d)

Zone No 2 (b) (Special Home Activities Zone),

(e)

Zone No 2 (v) (Village Zone),

(f)

Zone No 4 (a) (Industrial Zone).

Environmental Plan 1986

[1]      Clause 5 Interpretation

Insert in alphabetical order in clause 5 (1):

bulky goods premises means a building or place the principal purpose of which is the sale, hire or display of bulky goods, being goods that are of such size or weight as to require:

(a)

a large area for handling, display or storage, and

(b)

direct vehicular access to the site of the building or place by members of the public for the purpose of loading or unloading such goods into or from their vehicles after purchase or hire,

and including goods such as floor and window supplies, furniture, household electrical goods, equestrian supplies and swimming pools, but does not include a building or place used for the sale of foodstuffs or clothing unless their sale is ancillary to the sale or hire or display of bulky goods.

[2]      Clause 9 Zone objectives and development control table

Insert “bulky goods premises;” in alphabetical order in item 4 of the matter relating to Zones Nos 1 (a), 1 (c), 2 (a) and 2 (b) in the Table to clause 9.

[3]      Clause 9, Table

Omit “Institutions;” from item 4 of the matter relating to Zone No 2 (v).

Insert instead “Bulky goods premises; institutions;”.

Insert at the end of paragraph (c) of item 1 of the matter relating to

Zone No 4 (a):

, and

(d)

to encourage development for the purposes of bulky goods premises on appropriate land fronting the Newell Highway.

Omit “Any purpose” from item 3 of the matter relating to Zone No 4 (a).

Insert instead “Bulky goods premises; any other purpose”.
