The applicant seeks special leave to appeal from part of the judgment of the Court of Appeal of the Supreme Court of Victoria (Beach JA and J Forrest A‑JA, Emerton P dissenting) made on 12 December 2024, dismissing the applicant's appeal on the relevant ground that the civil jury verdict as to liability was one that no jury acting reasonably could have reached on the evidence favourable to the respondent.
The proposed appeal raises no question of principle and has insufficient prospects of success to warrant a grant of special leave.
Special leave to appeal is refused with costs.
