Food Production (Safety) Exemptions Order 2003 (NSW)
I, the Minister for Agriculture, with the concurrence of the Minister administering the Food Act 1989 and the Minister administering the Fisheries Management Act 1994, and in pursuance of section 69 of the Food Production (Safety) Act 1998, make the following Order.

This Order is the Food Production (Safety) Exemptions Order 2003.
The holder of a licence under the Food Production (Seafood Safety Scheme) Regulation 2001 is exempt from each of the following provisions of that Regulation, but only in respect of activities authorised by the licence (other than the culture and harvesting of shellfish) and until the date specified in relation to the provision:
(a) clause 12 (to the extent to which it imposes on a licence the premises and vehicle conditions set out in Schedule 1)—1 July 2003,
(b) clause 20—1 July 2003.
Subject to subclause (3), the holder of a licence under the Food Production (Seafood Safety Scheme) Regulation 2001 is exempt from clause 2 of Schedule 5 to that Regulation in respect of activities authorised by the licence (other than the culture and harvesting of shellfish).
It is a condition of an exemption specified in subclause (2) that the holder of a licence prepares a food safety program that complies with clause 18 of that Regulation:
(a) in relation to those activities authorised by the licence that involve the collection of shellfish, processing of oysters or processing of smoked seafood—by 1 April 2003, and
(b) in relation to those activities authorised by the licence that are not referred to in paragraph (a) and to which the exemption relates—by 1 July 2003.
