s1 2 s4 Food Hygiene Amendment (No. 1) No. 70, 1996 ˙ Short title 1. This regulation may be cited as the Food Hygiene Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the Food Hygiene Regulation 1989 . ˙ Amendment of s 4 (Interpretation) 3.(1) Section 4(1), definitions “the Act” and “the Local Authority” — omit . (2) Section 4(1), definition “approved” , ‘Director-General’— omit, insert— ‘chief health officer’. (3) Section 4(3)(c) and (d)— omit . (4) Section 4— insert— ‘ (4) A reference in this regulation to a local government, in relation to a food store, food vehicle or activity relating to food, is a reference to the local government for the local government area in which the food store or food vehicle is situated, or in which the activity relating to food happens.’. ˙ Insertion of new s 4A 4. After section 4— insert— ˙ ‘ Application of Australian Standards ‘ 4A. A reference in this regulation to an Australian Standard is a reference to the standard as approved, from time to time, by the Standards Association of Australia.’.

Section 14(2)(b), ‘AS 1668, Part 2—1980, Ventilation Requirements’— omit, insert— ‘AS 1668, part 2—1991, Mechanical Ventilation for Acceptable Indoor Air Quality’. ˙ Replacement of s 34 (Use of cloths and towels for drying appliances or wiping food) 7. Section 34— omit, insert— ˙ ‘ Cloths used to wipe appliances or food ‘ 34.(1) This section applies to the use of a polishing or wiping cloth in, at or on a food store or food vehicle. ‘ (2) A person must not use a polishing cloth for any purpose other than as a polishing cloth. ‘ (3) A person must not use a wiping cloth for any purpose other than as a wiping cloth. ‘ (4) A person must not use an unclean cloth or used clothing as a polishing or wiping cloth. ‘ (5) In this section— “cloth” means a cloth of any material. “polishing cloth” means a cloth used to wipe or polish fruit or other food intended for sale. “wiping cloth” means a cloth used to dry or wipe an appliance used in connection with the handling of food.’.
s 8 4 s 10 Food Hygiene Amendment (No. 1) No. 70, 1996 ˙ Amendment of s 38 (Prohibition as to affected persons) 8.(1) Section 38(1)— omit, insert— ‘ 38.(1) This section applies to a person who— (a) is affected by, or is a carrier of, a disease that may be transmitted by the contamination of food; or (b) has a sore that is not covered by a waterproof bandage or dressing. ‘ (1A) The person must not do anything in, at or on a food store or food vehicle that might— (a) contaminate food or a food contact surface; or (b) transmit a disease to someone else.’. (2) Section 38— insert— ‘ (4) In this section— “sore” includes a boil or infected wound.’. ˙ Amendment of s 39 (Powers of Director-General or medical officer of health) 9. Section 39, ‘Director-General’— omit, insert— ‘chief health officer’. ˙ Amendment of s 47 (Restriction as to use of certain appliances) 10. Section 47(3), ‘Director-General’— omit, insert— ‘chief health officer’.
s 11 5 s 11 Food Hygiene Amendment (No. 1) No. 70, 1996 ˙ Amendment of s 56 (Licensing provisions) 11.(1) Section 56(1)— omit, insert— ‘ 56.(1) This part does not apply to a person conducting a business at a place if— (a) the only unpackaged food dealt with at the place is dairy produce and the business is conducted under any of the following licences under the Dairy Industry Regulation 1993 — (i) a producer’s licence; (ii) a processor’s licence; (iii) a carrier’s licence; (iv) a vendor’s licence; or (b) the only unpackaged food dealt with at the place is fish and the business is conducted under a commercial fisher licence under the Fisheries Regulation 1995 ; or (c) the only unpackaged food dealt with at the place is meat and the business is conducted under an accreditation under the MeatIndustry Act 1993 .’. (2) Section 56(3)(a), ‘Form 1’— omit, insert— ‘the approved form’. (3) Section 56(4)(a), ‘Form 2’— omit, insert— ‘the approved form’. (4) Section 56(6)(a), ‘Form 3’— omit, insert— ‘the approved form’. (5) Section 56(6)(f), ‘Form 4’— omit, insert—

(6) Section 56— insert— ‘ (8) In this section— “at” includes in or on. “dairy produce” has the meaning given by the Dairy Industry Act 1993 . “dealt with” means prepared, handled, stored, served or sold. “fish” has the meaning given by the Fisheries Act 1994 . “meat” has the meaning given by the Meat Industry Act 1993 . “place” includes premises, a vehicle and part of premises or a vehicle.’. ˙ Amendment of s 58 (Registration of premises, other places or vehicles) 12.(1) Section 58(2)(a), ‘Form 5’— omit, insert— ‘the approved form’. (2) Section 58(3)(a), ‘Form 6’— omit, insert— ‘the approved form’. (3) Section 58(4)(b), ‘Form 7’— omit, insert— ‘the approved form’. (4) Section 58(6)(a), ‘Form 8’— omit, insert— ‘the approved form’. (5) Section 58(6)(g), ‘Form 9’— omit, insert— ‘the approved form’.
