Her Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Food Act 2003.

Explanatory note
The object of this Regulation is to substitute the definitions of hogget and lamb in the meat food safety scheme prescribed by Part 9 of the Food Regulation 2015. The new definitions are substantially consistent with recent updates to the Export Control (Meat and Meat Products) Orders 2005 of the Commonwealth.
This Regulation is made under the Food Act 2003, including sections 102 (1) and (2) (d) and 139 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Food Amendment (Lamb and Hogget) Regulation 2019.
2 Commencement
This Regulation commences on 1 July 2019 and is required to be published on the
NSW legislation website.
3 Amendment of Food Regulation 2015
Clause 76 Definitions
Omit the definitions of hogget and lamb from clause 76 (1).
Insert in alphabetical order:
hogget means an ovine animal that has at least one permanent incisor
tooth, but no more than 2 permanent incisor teeth, in wear.
in wear, in relation to a permanent incisor tooth of an ovine animal,
means that the tooth can touch the pad of the upper jaw when the mouthof the animal is closed.
lamb means an ovine animal that:
(a) is under 12 months of age, or (b) does not have any permanent incisor teeth in wear.
