Food Amendment Act 2015

An Act to amend the Food Act 2003

[Royal Assent 13 November 2015]

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Food Amendment Act 2015 . 2CommencementThis Act commences on a day to be proclaimed. 3Principal ActIn this Act, the Food Act 2003 is referred to as the Principal Act. 4Section 4 amended (Interpretation) Section 4(1) of the Principal Act is amended as follows: (a) by inserting the following definition after the definition of label : mobile structure, in relation to a food business, means a vehicle, trailer, cart, tent, stall, booth, pontoon, table, barbeque, pizza oven, or other mobile structure, that is not permanently fixed to the whole, or part, of a building, structure or land, in, at or from which food is, or is intended to be, handled or sold; (b) by inserting the following paragraph after paragraph (c) in the definition of premises : (ca) a mobile structure; or 5Section 88 substituted Section 88 of the Principal Act is repealed and the following section is substituted: 88Single certificate of registration for whole State A certificate of registration of a food business, which is conducted in whole, or in part, in, at or from a mobile structure, issued by one council is sufficient to satisfy the requirement of registration in respect of that food business throughout the State. 6Repeal of ActThis Act is repealed on the three hundred and sixty fifth day from the day on which it commences.
