Food (Amendment) Act 1997

An Act to amend the Food Act 1992

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Food (Amendment) Act 1997.

Commencement

2.  (1)  Sections 1, 2 and 3 commence on the day on which this Act is notified in the Gazette.

(2)  Section 4, in so far as it inserts section 24A in the Principal Act, commences on a day fixed by the Minister by notice in the Gazette.

(3)  If section 4, in so far as it inserts section 24A in the Principal Act,  has not commenced before the end of the period of 3 months commencing on the day on which this Act is notified in the Gazette, that section, by force of this subsection, commences on the first day after the end of that period.

(4)  Section 4, in so far as it inserts section 24B in the Principal Act, commences at the expiration of a period of 12 months after the day on which this Act is notified in the Gazette.

Principal Act

3.  In this Act, “Principal Act” means the Food Act 1992.1

Insertion

4.  After section 24 of the Principal Act the following sections are inserted in Division 2 of Part III:

Illegal sale

“24A.  (1)  A person shall not sell eggs produced by a hen kept in a manner that constitutes an offence against a law of the Territory or that would constitute such an offence if the hen were so kept in the Territory.

Penalty: 50 penalty units or imprisonment for 6 months.

“(2)  Subsection (1) does not apply to the sale of a product in which eggs, the sale of which would otherwise be an offence under that subsection, are an ingredient.

Sale of eggs

“24B. A person shall not expose eggs for sale or sell eggs unless packaged with a conspicuous label that indicates, by means of a prescribed expression, the conditions under which the hens that produced the eggs are kept.

Penalty:  50 penalty units or imprisonment for 6 months.”.
