FOOD ACT 1989 - REGULATION

(Relating to the temperatures at which certain foods may be sold)

HIS Excellency the Governor, with the advice of the Executive Council, in pursuance of the Food Act 1989 and on the recommendation of the Food Advisory Committee, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 20 July 1990.

Amendments

2. The Food Regulations 1937 are amended by inserting after

Regulation 77 (6B) (e) the following paragraph:

(f) A person must not sell any food to which this clause applies if the

temperature of the food:

(i)         is above 5°C (in the case of food that is to be kept cold); or

(ii)        is below 60°C (in the case of food that is to be kept hot).

EXPLANATORY NOTE

Regulation 77 (6B) of the Food Regulations 1937 specifies temperatures at which

certain perishable foods intended for sale must be kept.

The object of this Regulation is to amend that clause to make it clear that the sale

(as well as the keeping) of such foods at temperatures outside the specified limits is

prohibited.
