FOOD ACT 1989—REGULATION

(Relating to the securing of eggs from contamination)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Food Act 1989 and on the recommendation of the Food Advisory Committee, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1st May, 1991.

Amendment

2. The Food Regulations 1937 are amended by inserting after

Regulation 78A the following Regulation:

FOR SECURING THE FREEDOM OF EGGS FROM

CONTAMINATION

78B. (1) A person must not sell whole eggs the shells of which are

cracked, except as provided by clause (2).

(2) A person may sell whole eggs having cracked shells to a manufacturer engaged in the production of pasteurised liquid egg and pasteurised liquid egg products, if the eggs are bought, or held out as being bought, by the manufacturer for use in that production only.

(3) In this Regulation, “eggs” includes eggs (of any avian species)

that are ordinarily consumed by humans.

EXPLANATORY NOTE

The object of this Regulation is to amend the Food Regulations 1937 so as to prohibit the sale of eggs having cracked shells (unless the eggs are to be used in the production of pasteurised liquid eggs or pasteurised liquid egg products).
