FOOD ACT 1989 - REGULATION

(Adopting certain provisions of a Standard of the

National Food Standards Code)

HIS Excellency the Governor, with the advice of the Executive Council, in pursuance of the Food Act 1989 and on the recommendation of the Food Advisory Committee, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 21 September 1990.

Amendments

2. The Food Standards Code set out in Schedule 1 to the Food Standards Code (Adoption) Regulation 1989 is amended by omitting after Standard S2 the matter relating to Standard S4 and by inserting instead the following matter:

S4-SAMPLES

(1) Subject to this Standard, an authorised officer who takes or otherwise obtains a sample of food with the intention that it be submitted for analysis shall take or otherwise obtain a sample of such size and, where appropriate, of such number and such size of sample units as will enable the proposed analysis to be carried out.

(2) An authorised officer who takes or otherwise obtains a

sample of food for the purpose of submitting it for microbiological
analysis:

(a) shall not divide that sample into separate parts;
(b) where the sample consists of one or more than one sealed package of a kind ordinarily sold by retail, shall submit for such analysis that sample in that package or those packages in an unopened and intact condition.

(3) The number of sample units and the minimum size or the description of each sample unit to be taken or otherwise obtained for the purpose of microbiological analysis in respect of the food specified in column 1 of Table 1 to this Standard shall, as regards the number, be the number specified in column 2 thereof set out opposite and in relation to that food and, as regards the minimum size or the description, be the minimum size or the description specified in column 3 thereof set out opposite and in relation to that food.
