FOOD ACT 1989 - REGULATION

(Adopting amendments to the National Food Standards Code)

HIS Excellency the Governor, with the advice of the Executive Council, in pursuance of the Food Act 1989 and on the recommendation of the Food Advisory Committee, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation takes effect on 5 October 1990.

Amendments
2. The Food Standards Code set out in Schedule 1 to the Food
Standards Code (Adoption) Regulation 1989 is amended as follows:

1.     Standard A1 is amended by omitting from clause (10A) (e) the word "glycol" and by inserting instead the word "glycerol".

2.     Standard A11 is amended:

(a)

by omitting from the Schedule the matter in Column 2 relating to Cyclamic acid and by inserting instead the matter "FCC p.214 1st Ed.";

(b)

by omitting from the Schedule the word "Glueconodelta-lactone" in Column 1 and by inserting instead the words "Glucono delta-lactone".

3.     Standard A12 is amended by omitting from clause (2A) the matter "03 or 08" and by inserting instead the matter "03 or Standard 08".

4.     Schedule 1 to Standard A14 is amended:

(a) by inserting in appropriate alphabetical order in Columns 2 and 3 respectively of the matter relating to Acephate the following matter:

(i) There shall be written in the label on or attached to a package containing a mixture of edible fats or edible oils or a mixture or blend of both of them, in standard type of 4.5 mm immediately following the brand name or, if the brand name appears more than once, immediately following the brand name appearing in the largest type size, the words:

"BLENDED EDIBLE (here state whether animal, vegetable or animal and vegetable) FAT" or, as the case may be, "BLENDED EDIBLE (here state whether animal, vegetable or animal and vegetable) OIL".

(b) by omitting clause (3) (b).

7. Standard H1 is amended:
(a) by omitting the proviso to clause (14) (a);
(b) by inserting after clause (14) the following clause:

(1 4A) Pasteurised milk, homogenised pasteurised milk, ultra heat treated milk or sterilised milk that has been prepared in accordance with clause (10A) is not modified milk for the purposes of clause (14).

8.    Standard H2 is amended by omitting from clause (19) (c) the words ''cream mixture or thickened cream" and by inserting instead the words "thickened cream, ultra heat treated thickened reduced cream, ultra heat treated thickened light cream".

9.     Standard L1 is amended:

(a) by omitting from clause (3) (b) (ii) (A) the word "syrups”;
(b) by omitting from clause (7) (d) (iii) (B) (2) the matter "1 00 micro-organisms" and by inserting instead the matter "100 coliforms".

10.   Standard 07 is amended by inserting in clause (4) (b) (i) after the word "he" the words "or she".

11.   The heading appearing before Standard S1 is omitted and the following heading is inserted instead:

PART S - MISCELLANEOUS

12.   Standard S2 is amended by omitting from clause (1) the word "man" and by inserting instead the word

"humankind".

EXPLANATORY NOTE

The object of this Regulation is to adopt the most recent modifications to the Food Standards Code of the National Health and Medical Research Council. The modifications contain provisions that:

(a) increase the maximum limits of certain residues allowable in food for sale;

and

(b) amend certain requirements in relation to ultra heat treated cream and
