FOOD ACT 1989 - REGULATION
(Adopting amendments to the National Food Standards Code)

HIS Excellency the Governor, with the advice of the Executive Council, in pursuance of the Food Act 1989 and on the recommendation of the Food Advisory Committee, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation takes effect on 20 July 1998.
Amendment
2. Standard H5 in the Food Standards Code set out in Schedule 1 to the Food Standards Code (Adoption) Regulation 1989 is amended by inserting after clause (2) the following clause:
(3) (a) Goat milk that has not been prepared and packed as specified in clause (4), (5) or (6) of this Standard shall not be sold for human consumption, except as provided by paragraph (c).
(b) Goat milk that has not been prepared and packed as specified in clause (4), (5) or (6) of this Standard may be used for manufacturing purposes, but only if the manufacturing process includes pasteurisation or treatment by any other time and temperature combination of equal or greater lethal effect on bacteria.

(c) A person may sell for human consumption goat milk that has not been prepared and packed as specified in clause (4), (5) OF (6) of this Standard if the goat milk is produced by a dairy operated in accordance with the conditions of a permit to operate the dairy issued by the Director-General.
EXPLANATORY NOTE
The object of this Regulation is to adopt one of the provisions of the Food
Standards Code of the National Health and Medical Research Council so as:
(a) to prohibit the sale for human consumption of goat milk that has not been prepared and packed in the manner specified in the Code (except where it comes from a dairy operated in accordance with the conditions of a permit issued by the Director-General of the Department of Health); and
(b) to permit the use of such milk for manufacturing purposes where the manufacturing process includes certain treatment of the milk
