His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Food Act 1989.

Explanatory note

Clause 18 of the Food (General) Regulation 1997 prohibits any animal (other than a fish) being taken into any premises that are used for the purpose of handling food. The object of this Regulation is to amend the clause so as to allow an assistance animal (such as a guide dog) to be taken into areas that are used by customers, including areas that are used for dining or drinking.

This Regulation is made under the Food Act 1989, including section 90 (2) (k) (the general regulation-making power).

1     Name of Regulation

This Regulation is the Food (General) Amendment (Assistance
Animals) Regulation 2000.

2 Amendment of Food (General) Regulation 1997

The Food (General) Regulation 1997 is amended as set out in

Schedule 1.

3 Notes

The explanatory note does not form part of this Regulation.

Omit “and table of contents” from the clause.
Insert instead “, table of contents and notes in the text of this Regulation”.

[2]     Clause 18 Animals and birds not to be kept on premises

Insert at the end of the clause:

However, a person may take an assistance animal into, or may allow an assistance animal to enter or be in, areas used by customers (including areas used for dining or drinking).

(3) In this clause:

assistance animal means an animal referred to in section 9 of the Disability Discrimination Act 1992 of the Commonwealth.

Note. That section refers to a guide dog, a dog trained to assist a person in activities where hearing is required and any other animal trained to assist a person to alleviate the effect of a disability.
