Fluoridation Regulations 2019

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Fluoridation Committee, make the following regulations under the Fluoridation Act 1968 .26 February 2019

1Short titleThese regulations may be cited as the Fluoridation Regulations 2019 . 2CommencementThese regulations take effect on 11 March 2019. 3InterpretationIn these regulations – Act means the Fluoridation Act 1968 ; fluoride concentration means the level of fluoride residual in water intended for human consumption. 4Prescribed fluoride concentration rangeFor the purposes of the Act, the prescribed fluoride concentration range is between, and including, 0.8 milligrams per litre and 1.1 milligrams per litre. 5Record-keepingA water supply authority having the control of a fluoridated water supply must keep the following records for the purposes of the Act: (a) a record of the volume of water treated each day by the water supply authority; (b) a record of the quantity of fluoride added to that water supply each day by the water supply authority; (c) a record of the results of analyses and tests of samples of water taken by the water supply authority from that water supply; (d) a record of the fluoride concentration in that water supply.

Penalty:  Fine not exceeding 5 penalty units.

6Analyses and tests (1)  A water supply authority having the control of a fluoridated water supply is to take samples from that water supply, for the purpose of making analyses and tests of those samples, from such points on the reticulation system, used in respect of that water supply, as the Committee determines for that system. (2)  A water supply authority is to cause a sample from a fluoridated water supply, taken in accordance with subregulation (1) , to be analysed and tested by a laboratory that is accredited by the National Association of Testing Authorities, Australia – (a) at least twice in each calendar month; or (b) at such other frequency as may be directed by the Committee. (3)  A water supply authority that has undertaken analyses and tests of a sample from a fluoridated water supply, taken in accordance with subregulation (1) , is to send details of the results of the analyses and tests taken in any calendar month to the Committee by the 15th day of the following calendar month. (4)  Despite subregulation (3) , a water supply authority having the control of a fluoridated water supply must notify the Committee within 24 hours after receiving the result of any analysis or test that shows that the fluoride concentration is in excess of 1.5 milligrams per litre.

Penalty:  Fine not exceeding 5 penalty units.
