s 1 3 s 2B Fluoridation of Public Water Supplies Regulation 1964 FLUORIDATION OF PUBLIC WATER SUPPLIES REGULATION 1964 [as amended by all amendments that commenced on or before 10 November 1997] ˙ Short title 1. This regulation may be cited as the Fluoridation of Public Water Supplies Regulation 1964 . ˙ Definitions 2. In this regulation— “approved form” means a form approved by the chief health officer. “average maximum air temperatures” , for a public water supply, means the annual average of maximum daily air temperatures based on temperature data obtained for a minimum term of 5 years recorded at the Climatological Station of the Bureau of Meteorology nearest to the reticulated area of the public water supply. ˙ Forms 2A. The chief health officer may approve forms for use under this regulation. ˙ Exempt person 2B. For section 3(1) of the Act, BHP Australia Coal Pty Ltd A.C.N. 010 595 721 is an exempt person for the public water supply for the township of Moranbah in the Shire of Belyando and the township of Dysart in the Shire of Broadsound. 1 1 Under the Act, s 3(2), the Act applies to a person exempted under this section as if the person were a local government.
s3 4 s6 Fluoridation of Public Water Supplies Regulation 1964 ˙ Notification 3.(1) A local government which decides to add fluorine to any public water supply under its control shall, before it commences to do so, notify the chief health officer of such decision. (2) Such notification shall be in the approved form and a separate notification shall be submitted in respect of each separate water supply in respect of which the local government has decided to add fluorine. ˙ Fluorine concentration 4.(1) The minimum and maximum concentrations for fluorine in public water supplies are stated in the schedule, columns 2 and 3 respectively opposite the average maximum air temperatures relative to the public water supply stated in the schedule, column 1. (2) The minimum and maximum concentrations of fluorine stated in the schedule include fluorine naturally present in the public water supply. ˙ Training 5. No person shall add fluorine to any public water supply who has not received training, satisfactory to the chief health officer, in the principles of fluoridation, the type of equipment to be operated, the operation and maintenance of such equipment, the method of estimating the concentration of fluorine in water, and the provisions of the Act and this regulation. ˙ Analysis of treated water 6.(1) Every local government which adds fluorine to its public water supply shall— (a) once at least in each month, or more frequently if directed by the chief health officer, collect and forward to the chief health officer, samples of treated water taken at such points as directed by the chief health officer (or a person approved by the chief health officer) so that the prescribed analyses of such treated water may be made; and
s7 5 s8 Fluoridation of Public Water Supplies Regulation 1964 (b) once in each quarter forward to the chief health officer a sample of the water prior to the addition of fluorine; and (c) once at least in each 24 hours, collect samples of treated water taken as it leaves the fluoridation equipment and make the prescribed analyses of such treated water; and (d) once at least in each week, or more frequently if directed by the chief health officer (or a person approved by the chief health officer) collect samples of treated water taken from at least 2 points on the reticulation system and make the prescribed analyses of such treated water; and (e) collect such additional samples of treated water as may be directed by the chief health officer (or a person approved by the chief health officer) and make the prescribed analyses of such treated water. (2) In this section— “prescribed analyses” , of treated water, means analyses of the fluorine content of the water using 1 of the following methods— (a) the SPADNS colorimetric method; (b) the ion-selective electrode method. ˙ Appointment of supervisor 7. The local government shall, subject to the approval in writing of the chief health officer, appoint a person or persons to supervise the addition of fluorine to its public water supply and to arrange for the collection and analyses of samples of water taken pursuant to this regulation. ˙ Records and results 8.(1) The local government shall keep accurate records of the volume of water to which fluorine has been added, the weight of fluorine added to the water and the results of analyses of samples of water taken from the public water supply pursuant to this regulation. (2) Such records and results shall be recorded daily in the approved
s 10 6 s 11 Fluoridation of Public Water Supplies Regulation 1964 form, and copies of such records and results shall be submitted to the chief health officer promptly following the end of each calendar month. (3) The local government shall also keep duplicate log sheets in the approved form and shall enter therein daily records of— (a) the stock of fluorine on hand; and (b) the amount of fluorine used during each day; and (c) the results of analyses of samples of water taken from the public water supply. (4) The log sheets shall be available for inspection by the chief health officer or a person approved by the chief health officer. ˙ Automatic feeding equipment 10.(1) A local government shall not add fluorine to a public water supply except by means of automatic feeding equipment in which the rate of feed of the fluorine compound is related to the rate of flow of water. (2) Such equipment shall at all times have an accuracy range of plus or minus 5% and no such equipment shall be installed without the prior permission of the chief health officer. (3) The local government shall operate the equipment at all times and shall maintain it in proper working condition. ˙ Additional requirements for addition of fluorine 11.(1) The following requirements shall at all times be observed by the local government in respect of the addition of fluorine to its public water supply— (a) the fluoridation equipment shall be kept in a separate building or in a separate room within a water treatment building in such a way that it is effectively separated from all other water treatment equipment; (b) the dry feeders forming part of the fluoridation equipment shall be fitted with dust collectors consisting of bag filters operating under positive air pressure and vented to the outside air so that the
s 11 7 s 11 Fluoridation of Public Water Supplies Regulation 1964 atmospheric concentration of fluorine in the working space shall not be deleterious to health; (c) each person employed in adding fluorine to the public water supply shall be provided with rubber gloves, an efficient individual toxic dust respirator and an adequate supply of respiratory filter pads to permit of filter pads being changed twice weekly; (d) there shall be provided in each room or place where persons are employed in adding fluorine to a public water supply, or in other adjacent accommodation, a wash basin with an adequate supply of running water; and sufficient soap, nail brushes, and either an adequate supply of paper towels or a clean towel or other suitable material. Any such towel or other material shall be renewed for each person so employed as frequently as necessary; (e) stocks of fluorine shall be kept in a separate building, or in a separate room within the water treatment plant in such a way that they are separated from other substances used for water treatment. Such stocks shall at all times be kept under weatherproof conditions; (f) any spillage of fluorine which may occur shall be promptly hosed away in such manner that no part thereof may enter the public water supply. No portion of any such spillage shall be removed by dry sweeping; (g) each person employed in adding fluorine to the public water supply shall be thoroughly instructed in the precautions to be followed in handling fluorine; (h) a copy of this regulation shall be posted in a conspicuous position in the vicinity of the fluoridation equipment; (i) such additional requirements as the chief health officer considers necessary shall be observed by the local government.
s 12 8 s 12 Fluoridation of Public Water Supplies Regulation 1964 (2) Any person employed in adding fluorine to the public water supply of a local government shall use the materials and equipment provided for that purpose strictly in accordance with the foregoing requirements of this regulation, and shall strictly observe the instructions given to the chief health officer for handling fluorine and such additional requirements as the chief health officer considers necessary to be observed by such persons. ˙ Non-returnable containers 12. A local government shall dispose of non-returnable containers from which fluorine has been removed by incinerating such containers or where the containers are of incombustible materials by burying and covering them with at least 30 cm of earth.
