s1 3 s4 Fluoridation of Public Water Supplies Amendment (No. 1) No. 13, 1996 ˙ Short title 1. This regulation may be cited as the Fluoridation of Public Water Supplies Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the FluoridationofPublicWaterSuppliesRegulation 1964 . ˙ Replacement of s 2 (Interpretation) 3. Section 2— omit, insert— ˙ ‘ Definitions ‘ 2. In this regulation— “approved form” means a form approved by the chief health officer. “average maximum air temperatures” , for a public water supply, means the annual average of maximum daily air temperatures based on temperature data obtained for a minimum term of 5 years recorded at the Climatological Station of the Bureau of Meteorology nearest to the reticulated area of the public water supply.’. ˙ Insertion of new ss 2A and 2B 4. Before section 3— insert — ˙ ‘ Forms ‘ 2A. The chief health officer may approve forms for use under this regulation. ˙ ‘ Exempt person ‘ 2B. For section 3(1) of the Act, BHP Australia Coal Pty Ltd A.C.N. 010 595 721 is an exempt person for the public water supply for the

Section 3, ‘or to the effect of Form 1 of the Schedule hereto’— omit, insert— ‘the approved form’. ˙ Replacement of s 4 6. Section 4— omit, insert — ˙ ‘ Fluorine concentration ‘ 4.(1) The minimum and maximum concentrations for fluorine in public water supplies are stated in the schedule, columns 2 and 3 respectively opposite the average maximum air temperatures relative to the public water supply stated in the schedule, column 1. ‘ (2) The minimum and maximum concentrations of fluorine stated in the schedule include fluorine naturally present in the public water supply.’. ˙ Amendment of s 8 7.(1) Section 8, ‘form or to the like effect of Form 2 of the Schedule hereto’— omit, insert — ‘approved form’. (2) Section 8, ‘copy’— omit, insert — ‘copies’. 1 Under the Act, s 3(2), the Act applies to a person exempted under this section as if the person were a local government.

(2) In the provisions mentioned in subsection (1), ‘Director-General’— omit, insert — ‘chief health officer’. ˙ Insertion of new section headings 9. Immediately before a section mentioned in the schedule, column 1, insert the section heading set out opposite in the schedule, column 2. ˙ Replacement of sch 10. Schedule— omit, insert —

The following orders in council made under the Act are repealed— • the order in council published in the gazette on 8 May 1971 • the order in council published in the gazette on 19 October 1974.
