I, JULIE BISHOP, Minister for Ageing, make this Determination under paragraph 52-1 (1) (a) of the Aged Care Act 1997.

  1. Name of Determination

This Determination is the Flexible Care (Transition Care) Subsidy Amount Determination 2005.

  1. Commencement

This Determination commences on 1 July 2005.

  1. Definitions

In this Determination:

Act means the Aged Care Act 1997.

transition care has the meaning given by section 15.28 of the Flexible Care Subsidy Principles 1997.

  1. Amount of flexible care (transition care) subsidy

(1)   For the purposes of paragraph 52-1 (1) of the Act, the amount of flexible care subsidy that is payable to an approved provider in respect of:

(a)    a day; and

(b)    a care recipient who is provided with flexible care in the form of transition care by the approved provider on that day;

is $102.77.

(2)   To the extent that this Determination is inconsistent with the Determination expressed to have been made under paragraph 52-1 (b) of the Act on 23 June 2004, and known as ‘ACA Ch. 3 No. 17/2004’, this Determination prevails.
