Fishing Levy (Western Deep Water Trawl Fishery) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fishing Levy Act 1991 and the Fisheries Management Act 1991.

1.   Amendment

1.1   The Fishing Levy (Western Deep Water Trawl Fishery) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 2 (Interpretation)

2.1   Definition of “fishing permit”:

Omit “for fishing in”, substitute “in relation to”.

2.2   Definition of “Western Deep Water Trawl Fishery”:

Omit the definition, substitute:

“‘Western Deep Water Trawl Fishery’ means fishing by way of trawling in the area specified in the Schedule.”.

2.3   Add at the end:

“(2)

The origin of geographical coordinates in the Schedule is the Australian Geodetic Datum 1966 (AGD66).”.

3.   Regulation 3 (Amount of levy)

3.1   Omit the regulation, substitute:

“3.

For the purposes of section 6 of the Levy Act, the amount of levy prescribed for a fishing permit that is granted during the period beginning on 1 July 1995 and ending at the end of 30 June 1996 is $2,205.50 for the financial year beginning on 1 July 1995.”.

4.   Regulation 4 (When levy is due)

4.1   Omit the regulation, substitute:

“4.

For the purpose of section 110 of the Management Act, levy for a fishing permit referred to in regulation 3 must be paid on or before 15 January 1996.”.

5.   Schedule (Western Deep Water Trawl Fishery)

5.1   Omit the heading, substitute:

 “SCHEDULE Regulation 2

AREA OF THE WESTERN DEEP WATER TRAWL FISHERY”.
