Fishing Levy (South East Fishery) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fishing Levy Act 1991 and the Fisheries Management Act 1991.

1.   Commencement

1.1   These Regulations commence on 1 December 1995.

2.   Amendment

2.1   The Fishing Levy (South East Fishery) Regulations are amended as set out in these Regulations.

3.   Regulation 2 (Interpretation)

3.1   After subregulation 2 (1), insert:

 “(1A) The origin of geographical coordinates used in these Regulations is the Australian Geodetic Datum 1966 (AGD66).”.

4.   Regulation 3 (Amount of levy)

4.1   Subregulation 3 (1):

Omit “on or after the commencement of these Regulations”, substitute “in the period that starts on 1 December 1995 and ends on 30 November 1996”.

[NOTE: The following note is taken to be added at the end of regulation 3:

“[NOTE: Under the Primary Industries and Energy Research and Development Act 1989, a part (the “research component”) of levy imposed by the Fishing Levy Act 1991 is to be paid to the Fisheries Research and Development Corporation for research and development activities relating to the fishing industry. It is proposed, in respect of a fishing permit referred to in regulation 3, that, in relation to a scheduled species, the proportion specified in the Note to Schedule 2 of the amount of levy for each unit of quota specified in Column 3 in Schedule 2 of the item relating to that species will be paid to the Corporation as the fishery’s contribution to the research component for the financial year ending on 30 June 1996.]”.]

5.   Regulation 4 (When levy is due and payable)

5.1   Omit the regulation, substitute:

When levy is due and payable

 “4.For the purposes of section 110 of the Management Act, levy is due and payable for a fishing permit as follows:

  • (a)

    in the case of a fishing permit granted before 12 April in a year:

    • (i)

      one third of the amount of levy before the end of 28 days after the grant of the fishing permit; and

    • (ii)

      the balance of the amount of levy on or before 10 May in that year;

  • (b)

    in the case of a permit granted on or after 12 April in a year—before the end of 28 days after the grant of the fishing permit.”.

6.   Schedule 1 (Specified species)

6.1   Omit the Schedule, substitute:
