Fishing Levy (Northern Fish Trawl Fishery) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fishing Levy Act 1991 and the Fisheries Management Act 1991.

1.   Amendment

1.1   The Fishing Levy (Northern Fish Trawl Fishery) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3 (Amount of levy)

2.1   Omit the regulation, substitute:

“3.

For the purposes of section 6 of the Levy Act, the amount of levy prescribed for a fishing permit that is granted in the period beginning on 1 July 1994 and ending at the end of 30 June 1995 is:

• (a)

  in the case of a permit for the Arafura Sea and Gulf of Carpentaria Zone—$134; and

• (b)

  in the case of a permit for the Timor Sea Zone—$134; and

• (c)

  in the case of a permit for both the Arafura Sea and Gulf of Carpentaria Zone and the Timor Sea Zone—$268.”

3.   Regulation 4 (When levy is due and payable)

3.1   Omit the regulation, substitute:

When levy is due and payable

“4.

For the purposes of section 110 of the Management Act, levy for a fishing permit is due and payable:

• (a)

  in the case of a fishing permit granted on or before 23 December 1994—on or before 23 January 1995; and

• (b)

  in the case of a fishing permit granted after 23 December 1994—before the end of 28 days after the date of the grant.”.
