Fishing Levy (Kimberley Coast Prawn Trawl Fishery) Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fishing Levy Act 1991 and the Fisheries Management Act 1991.

Citation

 1. These Regulations may be cited as the Fishing Levy (Kimberley Coast Prawn Trawl Fishery) Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

Interpretation

 2.In these Regulations, unless the contrary intention appears:

“fishing permit” means a fishing permit for fishing in the Kimberley Coast Prawn Trawl Fishery;

“Kimberley Coast Prawn Trawl Fishery” means that part of the Australian fishing zone that is specified in the Schedule;

“Levy Act” means the Fishing Levy Act 1991;

“Management Act” means the Fisheries Management Act 1991.

Amount of levy

 3. For the purposes of section 6 of the Levy Act, the amount of levy prescribed in respect of a fishing permit is $9,000.

When levy is due and payable

 4. For the purposes of section 110 of the Management Act, levy is due and payable:

• (a)

  in the case of a fishing permit granted before the commencement of these Regulations—on or before 30 June 1993; and

• (b)

  in any other case—on the grant of a fishing permit.

SCHEDULE Regulation 2

KIMBERLEY COAST PRAWN TRAWL FISHERY

The area bounded by a line:

• (a)

  commencing at the intersection of the parallel of latitude 17∞ 20¢ south and the meridian of longitude 121∞ 50¢ east; and

• (b)

  running:

  • (i)

    from there southerly along that meridian to its intersection with the parallel of latitude 17∞ 50¢ south; and

  • (ii)

    from there easterly along that parallel to its intersection with the meridian of longitude 121∞ 55¢ east; and

  • (iii)

    from there northerly along that meridian to its intersection with the parallel of latitude 17∞ 40¢ south; and

  • (iv)

    from there easterly along that parallel to its intersection with the meridian of longitude 122∞ 00¢ east; and

  • (v)

    from there northerly along that meridian to its intersection with the parallel of latitude 17∞ 20¢ south; and

  • (vi)

    from there westerly along that parallel to the point where the line began.
