Fishing Levy (East Coast Deep Water Fishery) Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fishing Levy Act 1991 and the Fisheries Management Act 1991.

Citation

 1. These Regulations may be cited as the Fishing Levy (East Coast Deep Water Fishery) Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

Interpretation

 2.In these Regulations, unless the contrary intention appears:

“East Coast Deep Water Fishery” means that part of the Australian fishing zone that is specified in the Schedule;

“fishing permit” means a fishing permit for fishing in the East Coast Deep Water Fishery;

“Levy Act” means the Fishing Levy Act 1991;

“Management Act” means the Fisheries Management Act 1991.

Amount of levy

 3. For the purposes of section 6 of the Levy Act, the amount of levy prescribed in respect of a fishing permit is:

• (a)

  in the case of a permit granted for 3 months—$788; and

• (b)

  in the case of a permit granted for 12 months—$3,150.

When levy is due and payable

 4. For the purposes of section 110 of the Management Act, levy is due and payable:

• (a)

  in the case of a fishing permit granted before the commencement of these Regulations—on or before 30 June 1993; and

• (b)

  in any other case—on the grant of a fishing permit.

SCHEDULE Regulation 2

EAST COAST DEEP WATER FISHERY

The area bounded by a line:

• (a)

  beginning at the point of latitude 33° 35¢ south, longitude 153° 10¢ east; and

• (b)

  running:

  • (i)

    from there northerly along the geodesic to the point of latitude 30° south, longitude 154° 40¢ east; and

  • (ii)

    from there northerly along that meridian to its intersection with the parallel of latitude 27° 30¢ south; and

  • (iii)

    from there northerly along the geodesic to the point of latitude 27° 15¢ south, longitude 154° 20¢ east; and

  • (iv)

    from there northerly along that meridian to its intersection with the parallel of latitude 24° 30¢ south; and

  • (v)

    from there westerly along that parallel to its intersection with the meridian of longitude 154° east; and

  • (vi)

    from there northerly along the geodesic to the point of latitude 21° south, longitude 152° 55¢ east; and

  • (vii)

    from there north-westerly along the geodesic to the point of latitude 17° 30¢ south, longitude 147° east; and

  • (viii)

    from there north-westerly along the geodesic to the point of latitude 15° south, longitude 146° east; and

  • (ix)

    from there northerly along the geodesic to the point of latitude 13° south, longitude 145° east; and

  • (x)

    from there northerly along that meridian to its intersection with the parallel of latitude 10° 41¢ south; and

  • (xi)

    from there westerly along that meridian to its intersection with the parallel of longitude 144°  east; and

  • (xii)

    from there northerly along that meridian to its intersection with the parallel of latitude 10° 28¢ south; and

  • (xiii)

    from there easterly along that parallel to its intersection with the meridian of longitude 144° 10¢ east; and

  • (xiv)

    from there northerly along the geodesic to the point of latitude 10° 15¢ south, longitude 144° 12¢ east; and

  • (xv)

    from there northerly along the geodesic to the point of latitude 9° 40¢ south, longitude 144° 28¢ east; and

  • (xvi)

    from there northerly along the meridian of longitude 144° 28¢ east to its intersection with the outer limit of the Australian fishing zone; and

  • (xvii)

    from there southerly along the outer limit of the Australian fishing zone to its intersection with the parallel of latitude 33° 35¢ south; and

  • (xviii)

    from there westerly along the parallel of latitude 33° 35¢ south to the point where the line began.
