Fishing Levy (East Coast Deep Water Fishery) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fishing Levy Act 1991 and the Fisheries Management Act 1991.

1.   Amendment

1.1   The Fishing Levy (East Coast Deep Water Fishery) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3 (Amount of levy)

2.1   Omit the regulation, substitute:

Amount of levy

“3.

(1) For the purposes of section 6 of the Levy Act, the amount of levy prescribed for a fishing permit that is granted for 3 months is:

• (a)

  in the case of a permit granted on or before 30 June 1993—$788; and

• (b)

  in the case of a permit granted in the period beginning on 1 July 1993 and ending at the end of 30 June 1994—$723.

“(2)

For the purposes of section 6 of the Levy Act, the amount of levy prescribed for a fishing permit that is granted for 12 months is:

• (a)

  in the case of a permit granted on or before 30 June 1993—$3,150; and

• (b)

  in the case of a permit granted in the period beginning on 1 July 1993 and ending at the end of 30 June 1994—$2,889.”.

3.   Regulation 4 (When levy is due and payable)

3.1   Omit the regulation, substitute:

When levy is due and payable

“4.

For the purposes of section 110 of the Management Act, levy is due and payable for a fishing permit:

• (a)

  if the permit is granted before the commencement of this regulation—on or before 14 April 1994; and

• (b)

  if the permit is granted after the commencement of this regulation—on the grant of the permit.”.
