Fishing Levy Amendment Regulations 2004 (No. 1)1

I, PHILIP MICHAEL JEFFERY, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Management Act 1991 and the Fishing Levy Act 1991.

1Name of Regulations

 These Regulations are the Fishing Levy Amendment Regulations 2004 (No. 1).

2Commencement

 These Regulations commence on the date of their notification in the Gazette.

3Amendment of Fishing Levy Regulations 2003

Schedule 1 amends the Fishing Levy Regulations 2003.

4A.1Definition

 In this Part:

ESF fishing permit means a fishing permit for the Eastern Skipjack Fishery.

4A.2Amount of levy

 For section 6 of the Levy Act, for an ESF fishing permit that is in force on or after 1 July 2003 and on or before 30 June 2004, the amount of levy is $3 185.85, including a research component of $191.

4A.3When levy must be paid

 For section 110 of the Management Act, the levy mentioned in regulation 4A.2 must be paid on or before the later of the following:

• (a)

  31 May 2004;

• (b)

  28 days after the invoice date for the levy.

20A.1Definition

 In this Part:

WSF fishing permit means a fishing permit for the Western Skipjack Fishery.

20A.2Amount of levy

 For section 6 of the Levy Act, for an ESF fishing permit that is in force on or after 1 July 2003 and on or before 30 June 2004, the amount of levy is $3 185.85, including a research component of $191.

20A.3When levy must be paid

 For section 110 of the Management Act, the levy mentioned in regulation 20A.2 must be paid on or before the later of the following:

• (a)

  31 May 2004;

• (b)

  28 days after the invoice date for the levy.
