I, PETER JOHN HOLLINGWORTH, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fisheries Management Act 1991 and the Fishing Levy Act 1991.

1Name of Regulations

 These Regulations are the Fishing Levy Amendment Regulations 2002 (No. 1).

2Commencement

 These Regulations commence on gazettal.

3Amendment of Fishing Levy Regulations 2001

Schedule 1 amends the Fishing Levy Regulations 2001.

8.1Definition

 In this Part:

SPF fishing permit means a fishing permit for the Small Pelagic Fishery.

  Subregulation (1) does not apply to a SPF fishing permit (the first permit) that permits its holder to fish in Zone A of the Small Pelagic Fishery Area if, when the permit was granted:

  • (a)

    the holder also held a SPF fishing permit (the second permit) that permitted the holder to fish in Zone B, C or D of that area; and

  • (b)

    the first and second permits apply to the same boat.
