2 Fishing Industry Organization and Marketing Amendment (No. 2) No. 401, 1992 ˙ Short title 1. This regulation may be cited as the Fishing Industry Organization and Marketing Amendment Regulation (No. 2) 1992 . ˙ Amended regulation 2. The Fishing Industry Organization and Marketing Regulation 1991 is amended as set out in this regulation. ˙ Amendment of s.36 (Taking of certain fish) 3. Section 36(2)— omit, insert— ‘(2) Subsection (1) does not apply— (a) to an Aborigine or Torres Strait Islander taking, using or keeping fish under Aboriginal tradition or Island Custom; or (b) to a licensed fisher except in relation to— (i) Australian Bass ( Macquaria novemaculeata ); and (ii) Golden Perch ( Macquaria ambigua ); and (iii) Mary River Cod ( Maccullochella sp.); and (iv) Murray Cod ( Maccullochella peeli ); and (v) Saratoga ( Scleropages leichardti ); and (vi) Silver Perch ( Bidyanus bidyanus ); or (c) to the having in possession of cleaned and preserved molluscs as part of a genuine shell collection held by a shell collector. ’. ˙ Replacement of Schedule 4 (Limit on taking of certain species of fish) 4.
