2 Fishing Industry Organisation and Marketing Amendment (No. 5) No. 324, 1993 ˙ Short title 1. This regulation may be cited as the Fishing Industry Organisation and Marketing Amendment Regulation (No. 5) 1993 . ˙ Amended regulation 2. The Fishing Industry Organisation and Marketing Regulation 1991 is amended as set out in this regulation. ˙ Insertion of new Part 8A 3. After Part 8— insert— ‘PART 8A—EXEMPTIONS ˙ ‘Exemption ‘42A.(1) A fisher who is engaged in the treatment of saucer scallop ( Amusium japonicum balloti ) is exempt from the operation of section 36(1) of the Act if the fisher is on a vessel that— (a) is the subject of a commercial fishing vessel licence endorsed with fisheries endorsement E; and (b) is in the charge of a master fisherman; and (c) is in an area of Queensland waters described in Schedule 9. ‘(2) In this section— “fisher” means the holder of— (a) a commercial fishing vessel licence; or (b) a master fisherman’s licence; or (c) an assistant fisherman’s licence. ’.
3 Fishing Industry Organisation and Marketing Amendment (No. 5) No. 324, 1993 ˙ Insertion of new Schedule 9 4. After Schedule 8— insert— ‘SCHEDULE 9 ‘RELEVANT QUEENSLAND WATERS section 42A ‘1. The area of waters within Tin Can Inlet within 1 n mile of the township of Tin Can Bay. 2. The area in Hervey Bay bounded by a line commencing at the red beacon at the entrance of the Urangan Boat Harbour— (a) then in a direct line to the most northern point on Big Woody Island; (b) then in a southerly direction by high water mark along the western foreshore of Big Woody Island to the intersection with the parallel of latitude 25°18'35" south latitude; (c) then in a direct line in a south-westerly direction to the intersection with the mainland at the south head of Pulgul Creek; (d) then by high water mark in a northerly direction along the foreshore and harbour wall to the point of commencement. 3. The area of water in Hervey Bay bounded by a line commencing at the Special Marker known as EU1— (a) then in a direct line in a north-easterly direction to the South Cardinal Marker known as S6; (b) then in a direct line in a westerly direction to the Special Marker known as S4; (c) then in a direct line in a south-easterly direction to the point of commencement.

The area adjacent to Bundaberg within the Burnett River downstream of the traffic bridge to a line across the river at right angles from the pump station at the Millaquin Sugar Mill. 5. The area adjacent to Gladstone bounded by a line commencing at the green beacon located at the northern head of Auckland Creek— (a) then in a direct line in a northerly direction to the rear lead at Targinie Channel located at Middle Bank; (b) then in a direct line in a north-westerly direction to Permain Point located on the most southern point of Picnic Island; (c) then by high water mark along the western foreshores of Picnic Island to the most northern point of Picnic Island; (d) then in a direct line in a south-westerly direction to a point on the foreshore at the northern side of Clinton Wharf; (e) then in a southerly direction by high water mark along the foreshore to the north head of Auckland Creek; (f) then to the point of commencement. 6. The area adjacent to Double Head near Yeppoon bounded by a line commencing at the intersection with the mainland of the parallel of latitude 23°10'30" south (near Bluff Point)— (a) then east along the parallel of latitude 23°10'30" south, to its intersection with 150°48'30" east longitude; (b) then north along the meridian 150°48'30" east longitude to its intersection with the parallel of latitude 23°09'45" south; (c) then due west along the parallel of latitude 23°09'45" to Double Head; (d) then north-westerly in a direct line to Wreck Point; (e) then southerly by high water mark along the foreshore to the point of commencement. 7. The area west of Stone Island (near Bowen) bounded by a line commencing at Dalrymple Point, on the mainland— (a) then easterly in a direct line to the west side of South Head on Stone Island;
5 Fishing Industry Organisation and Marketing Amendment (No. 5) No. 324, 1993 (b) then southerly along the western shore of Stone Island to the end of the sand spit at the south-westerly extremity of Stone Island; (c) then westerly in a straight line to a lateral mark known as M5; (d) then northerly in a straight line to the point of commencement. 8. The area on the western side of Cape Cleveland bounded by a line commencing at Cape Cleveland— (a) then due west by a straight line to its intersection with the meridian of longitude 147° east; (b) then due south by the meridian of longitude 147° east to its intersection with the parallel of latitude 19°12' south; (c) then due east by the parallel of latitude 19°12' south to its intersection with the mainland; (d) then northerly by high water mark to the point of commencement. 9. The area on the western side of Magnetic Island bounded by a line commencing at the intersection of the west shore of Magnetic Island with the parallel of latitude 19°08' south— (a) then due west by the parallel of latitude 19°08' south to its intersection with the meridian 146°46' east; (b) then due south by the meridian of longitude 146°46' east to its intersection with the parallel of latitude 19°09' south; (c) then due east by the parallel of latitude 19°09' south to its intersection with the shore of Magnetic Island at high water mark; (d) then by the shore at high water mark to the point of commencement. 10. The area in North East Bay bounded by a line commencing at the intersection of the north shore of Great Palm Island with the meridian of longitude 146°41' east— (a) then due north by the meridian of longitude 146°41' east to its intersection with the parallel of latitude 18°43' south; (b) then due west by the parallel of latitude 18°43' south to its intersection with the meridian of longitude 146°40' east;
6 Fishing Industry Organisation and Marketing Amendment (No. 5) No. 324, 1993 (c) then due south by the meridian of longitude 146°40' east to its intersection with the shore of Great Palm Island at high water mark; (d) then easterly by the shore at high water mark to the point of commencement. 11. The area of waters within 1 000 m of the seaward end of the Lucinda Services Jetty. ’. ˙ Repeal of order in council 5.
