3 Fishing Industry Organisation and Marketing Amendment (No. 3) No. 235, 1993 ˙ Short title 1. This regulation may be cited as the Fishing Industry Organisation and Marketing Amendment Regulation (No. 3) 1993 . ˙ Commencement 2. This regulation commences on 1 July 1993. ˙ Amended regulation 3. The Fishing Industry Organisation and Marketing Regulation 1991 is amended as set out in this regulation. ˙ Amendment of s.3 (Interpretation) 4. Section 3— insert— ‘ “charter vessel” means a vessel in relation to which a certificate of survey has been issued under the Queensland Marine Act 1958 or the Navigation Act 1912 of the Commonwealth for 1 of the following classes— (a) Class 1A, 2A, 3A; (b) Class 1B, 2B, 3B; (c) Class 1C, 2C, 3C; (d) Class 1D; “extended fishing charter” means the use of a charter vessel for a continuous period of 48 hours or more for purposes that include— (a) the taking of fish, other than for a commercial purpose; and (b) the carriage of persons for financial reward; “fillet” means the whole of 1 side of a fish, other than the head and tail; ’.
4 Fishing Industry Organisation and Marketing Amendment (No. 3) No. 235, 1993 ˙ Amendment of s.10 (Licensed commercial fishing vessel) 5. After section 10(2)— insert— ‘(3) The Authority may determine the number, not greater than 4, of tender commercial fishing vessels that may be had in possession or employed at the same time as, and in association with, a primary commercial fishing vessel in reef line fishery operations. ‘(4) The Authority may determine if a single tender commercial fishing vessel may be had in possession or employed at the same time as, and in association with, a primary commercial fishing vessel in restricted reef line fishery operations. ’. ˙ Amendment of s.22 (Endorsement symbols) 6. Section 22(1)— omit, insert— ‘22.(1) The Authority— (a) must endorse a primary commercial fishing vessel licence; and (b) may endorse a tender commercial fishing vessel licence; with 1 or more of the symbols ‘A’, ‘B’, ‘C’, ‘E’, ‘F’, ‘G’, ‘H’, ‘I’, ‘J’, ‘K’, ‘L1’, ‘L2’, ‘L3’, ‘M’, ‘N’, ‘O’, ‘P’, ‘Q’, ‘R’, ‘T’, ‘U’, ‘V’, ‘W’, ‘X’ and ‘Z’. ’. ˙ Insertion of new ss.33A–33B 7. After section 33— insert— ˙ ‘Identification and counting of fish taken ‘33A.(1) Subject to subsection (2), if a person takes or is in possession of a fish on a vessel, the person must not remove the skin from the fish, or a fillet or any other portion of the fish, until the fish is brought ashore from the vessel at the end of the journey during which the fish was taken.
5 Fishing Industry Organisation and Marketing Amendment (No. 3) No. 235, 1993 ‘(2) A person may remove the skin from a fish, or a fillet or any other portion of the fish, other than a square area of skin measuring at least 10 cm 2 if— (a) the fish was taken on an extended fishing charter; and (b) the owner of the charter vessel on which the extended fishing charter took place completes a logbook under section 33B. ‘(3) A person who takes a fish, or is in possession of a fish, must not divide the fish into fillets or other portions unless the person divides the fish in a way that allows an inspector to readily count the number of fish that were taken by, or were in the possession of, the person. ˙ ‘Extended fishing charter logbooks ‘33B.(1) The owner of a charter vessel used for an extended fishing charter must maintain a logbook. ‘(2) The logbook must be in the form approved by the Authority. ‘(3) The owner of a charter vessel used for extended fishing charters must give to the Authority a copy of the entries in the logbook for each month. ‘(4) The copy must be given to the Authority within 14 days after the end of each month. ‘(5) A person must not make an entry in a logbook that is false or misleading. ‘(6) A person must not give the Authority a false or misleading copy of an entry in a logbook. ’. ˙ Replacement of s.36 (Taking of certain fish) 8. Section 36— omit, insert— ˙ ‘Prohibition against taking certain fish ‘36.(1) In this section— “allowed number of fish” means the number of fish specified in
6 Fishing Industry Organisation and Marketing Amendment (No. 3) No. 235, 1993 Schedule 4 in relation to a species mentioned in Schedule 4. ‘(2) A person must not take, or have in possession— (a) of all species of fish mentioned in Schedule 4 under the heading ‘Reef Fish’—more than 30 fish; and (b) more than the allowed number of fish. ˙ ‘Non-application of prohibition against taking certain fish ‘36A.(1) Section 36 does not apply to— (a) a person who is a licensed fisher, other than in relation to the following species of fish— (i) Australian Bass ( Macquaria novemaculeata ); (ii) Golden Perch ( Macquaria ambigua ); (iii) Mary River Cod ( Maccullochella sp. ); (iv) Murray Cod ( Maccullochella peeli ); (v) Saratoga ( Scleropages leichardti ); (vi) Silver Perch ( Bidyanus bidyanus ); or (b) a person who takes or has in possession more than the allowed number of fish under the heading ‘Reef Fish’ in Schedule 4 if— (i) the person takes the fish before 1 July 1994; and (ii) the person takes the fish on an extended fishing charter; and (iii) the person ensures that a portion of square area, measuring at least 10 cm 2 , of the skin of each fish taken is retained on the fish, or each fillet or other portion of the fish; and (iv) the owner of the charter vessel completes a logbook under section 33B; or (c) a person who is the holder of a docket, under section 44 of the Act, for fish mentioned in section 36(2); or (d) a person who is permitted under the Act or the FisheriesAct1976 to take more than the allowed number of fish; or
7 Fishing Industry Organisation and Marketing Amendment (No. 3) No. 235, 1993 (e) a person is in possession of more than the allowed number of fish for the purposes of keeping the fish in the form of cleaned and preserved molluscs in a bona fide shell collection. ‘(2) Subsection (1)(b) does not apply to Potato Cod ( Epinephelus tukula ), Queensland Groper ( Epinephelus lanceolatus ), and Wrasse—Maori ( Cheilinus undulatus ). ˙ ‘Exemption for Aborigines and Torres Strait Islanders ‘36B. An Aborigine or Torres Strait Islander who takes fish according to Aboriginal tradition or Island custom is exempted from sections 33A, 34 and 36. ’. ˙ Insertion of new s.51 9. After section 50— insert— ˙ ‘Savings ‘51. Paragraph L2.3 of Schedule 3 does not apply to the use of a tender commercial fishing vessel in reef line fishery operations if the licence in relation to the vessel is in force and endorsed with the line fishery symbol ‘L’ immediately before the commencement of this section. ’. ˙ Amendment of Schedule 3 (Fisheries endorsements) 10. Schedule 3 (endorsement L)— omit, insert— ‘L1. Line fishery 1. Line fishery operations may be carried out in all tidal waters other than tidal waters bounded by a line commencing at a point which, at high water, is the northernmost extremity of Cape York, then— (a) in an easterly direction to the intersection of 10°41' south latitude and 145° east longitude; then (b) in a southerly direction along the meridian of longitude 145° east
8 Fishing Industry Organisation and Marketing Amendment (No. 3) No. 235, 1993 to its intersection with the parallel of latitude 13° south; then (c) in a south-easterly direction to the intersection of 15° south latitude and 146° east longitude; then (d) in a south-easterly direction to the intersection of 17°30' south latitude and 147° east longitude; then (e) in a south-easterly direction to the intersection of 21° south latitude and 152°55' east longitude; then (f) in a south-easterly direction to the intersection of 24°30' south latitude and 154° east longitude; then (g) in a westerly direction along the parallel of latitude 24°30' south to its intersection with the coastline at high water mark; then (h) in a generally northerly direction along the high water mark to the point of commencement. 2. Only apparatus having serial no. 7, 8, 9 or 35 is to be used in line fishery operations. 3. The licence for a tender commercial fishing vessel had in possession in line fishery operations must be endorsed with the line fishery symbol ‘L1’. ‘L2. Reef line fishery 1. Reef line fishery operations are only to be carried out in tidal waters bounded by the line mentioned in endorsement L1.1. 2. Only apparatus having serial no. 7, 8, 9 or 35 is to be used in reef line fishery operations. 3. Only the number of tender commercial fishing vessels authorised by the Authority may be had in possession or employed at the same time as, and in association with, a primary commercial fishing vessel in reef line fishery operations. 4. The licence for a tender commercial fishing vessel had in possession in reef line fishery operations must be endorsed with the reef line fishery symbol ‘L2’.

Restricted reef line fishery operations are only to be carried out in the tidal waters bounded by the line mentioned in endorsement L1.1. 2. Only apparatus having serial no. 7, 8, 9 or 35 is to be used in restricted reef line fishery operations. 3. Only the number of tender commercial fishing vessels (if any) authorised by the Authority may be had in possession or employed at the same time as, and in association with, a primary commercial fishing vessel in restricted reef line fishery operations. 4. The licence for a tender commercial fishing vessel had in possession in restricted reef line fishery operations must be endorsed with the restricted reef line fishery symbol ‘L3’. ’. ˙ Replacement of Schedule 4 (Limit on taking of certain species of fish) 11.
