s1 2 s4 Fishing Industry Organisation and Marketing No. 269, 1994 Amendment (No. 2) ˙ Short title 1. This regulation may be cited as the Fishing Industry Organisation and Marketing Amendment Regulation (No. 2) 1994 . ˙ Regulation amended 2. This regulation amends the Fishing Industry Organisation and Marketing Regulation 1991 . ˙ Replacement of section 36 (Prohibition against taking or having in possession certain fish) 3.(1) Section 36— omit, insert— ˙ ‘ Prohibition against taking or having in possession certain fish ‘ 36.(1) In this section and section 36A— “allowed number of fish” for a species means the number specified in Schedule 4 for the species; “reef fish” means a species of fish mentioned in Schedule 4 under the heading ‘Reef fish’. ‘ (2) A person must not take or have in possession— (a) more than 30 of all species of reef fish; or (b) more than the allowed number of fish for the species.’. ˙ Amendment of s 36A (Non-application of prohibition against taking or having in possession certain fish) 4.(1) Section 36A(1), ‘Section 36 does’— omit, insert— ‘Section 36(2) does’. (2) Section 36A(1)(b)— omit, insert—
s4 3 s4 Fishing Industry Organisation and Marketing No. 269, 1994 Amendment (No. 2) ‘(b) a person if— (i) the person takes reef fish on a vessel during an extended fishing charter; and (ii) the person ensures a portion of square area, measuring at least 10 cm 2 , of the skin of each fish is retained on the fish, or each fillet or other portion of the fish; and (iii) the owner of the vessel completes a logbook under section 33B; or’. (3) Section 36A(2)— omit, insert— ‘ (2) A reference to reef fish in subsections (1)(b) or (3) does not include the following— • potato cod ( Epinephelus tukala) • Queensland groper ( Epinephelus lanceolatus) • wrasse—Maori ( Cheilinus undulatus ). ‘ (3) A person to whom subsection 36A(1)(b) applies must not take or have in possession— (a) more than 60 of all species of reef fish; or (b) for reef fish—more than twice the allowed number of fish for the species; or (c) for other fish—more than the allowed number of fish for the species.’.
