The Parliament of Australia enacts:
This Act may be cited as the
Fisheries (Validation of Plans of Management) Act 2004.
This Act commences on the day on which it receives the Royal Assent.
(1) The purpose of this section is to provide certainty about the validity of:
(a) certain plans of management determined under the
Fisheries Management Act 1991 ; and(b) things done under or for the purposes of those plans.
(2) A plan of management determined, or purported to have been determined, by the Managing Director, or acting Managing Director, of the Australian Fisheries Management Authority under section 17 of the
Fisheries Management Act 1991 before the commencement of this section has effect, and is taken always to have had effect, as if it had been determined by the Australian Fisheries Management Authority.(3) Any amendment or revocation of such a plan made by the Managing Director, or acting Managing Director, of the Australian Fisheries Management Authority under section 20 of the
Fisheries Management Act 1991 before the commencement of this section has effect, and is taken always to have had effect, as if it had been made by the Australian Fisheries Management Authority.(4) Anything done under or for the purposes of such a plan of management, or such a plan of management amended as mentioned in subsection (3), is as valid, and is taken always to have been as valid, as it would have been if the plan had been determined, and the amendment had been made, by the Australian Fisheries Management Authority.
